A Cape Coral man has been charged with sexual assault, kidnapping and burglary with an assault or battery in an attack that occurred in Fort Myers three months ago.

Albert Black Jr., 31, was arrested by Fort Myers police on Tuesday. Officials say DNA evidence led them to Black.

He is accused of breaking into the victim’s central Fort Myers home in the early hours of May 1 while the victim was sleeping in her bedroom. She was awakened by the suspect and a short struggle ensued before she was assaulted, police said in a prepared statement.

The assailant then fled.

Due to the seriousness of the crime and the victim’s injuries the FMPD Crime Scene Unit and Detective Al Antonini responded to investigate. Police processed the crime scene and later released a sketch of the possible suspect. DNA evidence also was submitted to the Florida Department of Law Enforcement for testing.

On July 26, Antonini learned testing showed the DNA recovered in the case belonged to Black, officials said.

“DNA is irrefutable evidence. I am relieved that we caught the suspect and extremely proud of the investigative work by everyone involved,” said Chief Doug Baker.

Antonini also learned that Black was on probation for a similar crime. He was released from prison in 2010. The detective notified Black’s probation officer which ultimately led to Black’s arrest.

Black was taken into custody without incident.
