A 20th Judicial District assistant state attorney overheard a man say to a woman he wasn’t accepting a plea deal and that he wanted the charges against him dropped.

The problem is, according to a State Attorney’s Office report, the man had been ordered to stay away from the woman on May 7 after he was arrested for battery.

Now David Frederick Drake, 58, of 1737 S.E. 44th Terrace, Cape Coral, faces additional charges of violation of an order of protection.

According to the report:

Just before 9:30 a.m. Tuesday, Assistant State Attorney Paul Poland was waiting for a sixth-floor elevator when he heard Drake telling the woman he wanted the domestic violence charges against him dropped and he wasn’t taking a plea deal.

Poland confirmed the woman, whose name was not released, was a victim of domestic violence and Drake was to have no contact with her.

Poland notified State Attorney’s Office Investigator Charles Lawson, but by the time Lawson arrived, Drake was gone.

“A short time later, David Drake reported back to the 6th floor of the State Attorney’s Office at which time he was placed under arrest for the violation of the no contact order,” according to the report.

Bond was denied.
