Police: Man threatens 12-year-old with gun

By Staff | Feb 3, 2009

A Cape Coral man is alleged to have battered the 12-year-old son of his roommate and threatened him if he did not turn off his light and lower the volume on his television Sunday night, a police report states.

Cape police arrested and charged Edwin Cabrera, 64, with aggravated assault with a deadly weapon and battery in the incident.

Cabrera reportedly told the victim to turn off his light, close his door and turn down the television or he would use his gun, which the victim told police Cabrera had shown him earlier in the day.

The victim told a third roommate about the threat, and attempted to call his mother when Cabrera grabbed the victim’s arm and demanded he leave the residence, according to reports.

Police responded to the home in the 1900 block of Southwest Embers Terrace at approximately 10:30 p.m. and discovered a loaded 9 mm handgun and a magazine with eight rounds in a case beneath Cabrera’s bed, reports state.

Cabrera appeared to have been drinking and seemed confused about who lived at the house, police said.

He was convicted of grand larceny in the state of New York in 1968, police discovered through a criminal history check.

Cabrera also was accused of aggravated assault in 2007 but was not adjudicated, police said.

Cabrera was taken to the Lee County Jail in apparent good health. He remained in custody on $120,000 bond Tuesday, according to booking records.
