A Cape Coral man was arrested and charged with possession of cocaine after asking a police officer for a ride in his patrol car then agreeing to a drug and weapons check.

Michael Ray Luciano, 21, of 440 N.W. First Lane, was charged Monday. He and a female came into contact with Officer Joshua Silko at about 6:18 p.m. when their car broke down at the intersection of Pondella Road and Pine Island Road, according to a Cape police report. The two were waiting for a friend to assist them.

Luciano and the female were able to get their vehicle started and drove it to the Lowe’s parking lot across the street. Silko said he followed in case they broke down again. Once parked, Luciano asked Silko if he could give them a ride back to the Chili’s to wait.

Silko said he agreed, but under the condition that they undergo a pat down for drugs and weapons for his safety. Luciano and the female reportedly agreed to the search.

Silko reported that upon searching Luciano, “I located a clear plastic baggie sticking out of his pocket. Inside I could see a smaller bag with black and yellow Batman symbols on it … After further examination of the bag I located two smaller baggies with the yellow and black Batman symbols on them, both containing a white powdery substance which was consistent with cocaine powder. A third small bag was located in another pocket containing suspect cocaine as well.”

According to the report, Luciano responded that he has “a little drug problem” and asked Silko to let him go. Luciano was placed under arrest and taken to the Lee County Jail in apparent good health.

Silko said he recognized the Batman-symboled baggies as drug-related from training and experience. The powder in each baggie tested positive for cocaine.
